All purchases realized on this website Wagenparts.com are exclusively governed by the Terms and Conditions detailed below. Wagenparts.com reserves the right to modify this Terms and Conditions at any time and without previous notice. The modified Terms and Conditions comes into effect after its publication on this web.

Wagenparts.com is a company headquartered in Cardenal Cisneros nº 17, 08197 Sant Cugat Del Valles, Spain.

Wagenparts.com adheres to the code of conduct of the Federation of Distance Selling Companies.

II. ORDER PROCESS

To place an order, we offer our customers different ways:

• On internet: directly on the page Wagenparts.com 24 hours on 24 and 7 days on 7 

• By e-mail: with the proposed purchase order (screen capture) and with an attached proof of payment.

With the confirmation of the order, the customer receives a confirmation email that constitutes proof of his order.

Our Customer Service Department is available by phone at +34 639 504 212 (number with no extra charge), from Monday to Friday 9h00-19h30 without interruption for assistance to purchase, order tracking and after sales service.

The Customer may also contact the Customer Service Department via the "Contact" section in this the website.

III. SECURED PAYMENT

A- MEANS OF PAYMENT

Wagenparts.com offers its customers various forms of payment:

• By Bank card.

• By PayPal: Secure enabled via Paypal transaction.

• By Bank transfer.

In the case of payment by credit card or PayPal, the charge will be made at the time of confirmation of payment, activating order preparation services. 

In the case of a bank transfer, the order will be taken into account when Wagenparts.com has received the full amount, activating only then the preparation of the order.

IV. PAYMENT OBLIGATION OF PAST ORDERS 

All order placed on this website obligues customer to pay immediately and entirely.

The purchases made in this website are submitted to a clause of reservation of property. These items remain the property of Wagenparts.com up to the full debit of the order price.

The burden of risk is transferred to the customer from the moment of delivery. From this time, the customer is responsible for the preservation of the items.

Wagenparts.com have the right to refuse to make a delivery or to honor an order if fraud by payment is suspected or if a non-payment of a previous order is detected.

V. INFORMATION PRODUCTS

The photos, texts, graphics, information and reproduced characteristics illustrating the products are provided for information purposes only, and may be subject to update without previous notice.

The products sold by Wagenparts.com must be installed and/or used only on vehicles recommended by the manufacturer of the item or manufacturer of the vehicle, and it must be done by a competent person and under his sole responsibility. Wagenparts.com not assume in any case the responsibility for the consequences of a bad installation or improper use of a product.

VI. PRICES

The prices of the products sold in Wagenparts.com include VAT and exclude delivery costs.

Prices remain valid while they are published on this website. Wagenparts.com reserves the right to change the prices at any time without previous notice.

"EXCHANGE" PRODUCTS

Certain parts require delivery of the same worn part in exchange for the new one. An additional charge "Refundable Fee" will be billed to the customer pending the receipt by Wagenparts.com of the worn parts. 

Once the worn part is received in Wagenparts.com the "Refundable Fee" will be refunded to the customer.

DELIVERY COSTS

Delivery costs are calculated at the moment of placing the order, depending on weight and destination. They are not included in the product price unless otherwise specified.

VII. VAT

For customers in the EU the VAT rate of cutomer country will be applied (member of the European Union.

VIII. AVAILABILITY

Wagenparts.com honors orders to the best of its own stock and of those of their suppliers.

In case of unavailability of a requested article, Wagenparts.com will look for another article always with the same technical characteristics, quality and similar price. 

If Wagenparts.com find an item that meets these criteria - basically the same product but another code or reference - and there is a price difference between the requested product and the product delivered, proceed as follows:

• If the price of the replacement product is lower than the price of the ordered item, the difference will be refunded to the customer.

• If the price of the replacement product is higher than the price of the ordered item, Wagenparts.com will contact the customer to decide whether he wishes to assume the additional cost, or cancel the order.

The customer will be informed as soon as the incident is detected and will retain the right to reject the replacement product until the expedition moment. 

IX. EXPEDITION AND DELIVERY 

PLACE OF DELIVERY

The Wagenparts.com products are:

1. made available at no additional charge, in one of the locations Wagenparts.com, or

2. delivered to the address indicated by the customer in its order.

DEADLINE AND DELIVERY TRACKING

The delivery of an order, will be shown in more details.

Customer will have a locator number of the shipping.

OPENING OF AN INCIDENCE IN CASE OF LATE DELIVERY

Wagenparts.com uses the deadlines set by carriers and an issue with the carrier will be opened as soon as a delivery delay is found abnormal. A solution will be provided to the customer not more than (5) days after the opening of the issue.

CONTROL PACKAGE AND ITS CONTENTS

Package delivery is done against a signature. The recipient is mandatory to check the condition of the packaging as well as the contents (missing piece, damaged package, broken parts, ...).

In case of incident:

• customer is invited to mention directly on the delivery order of the carrier and if necessary deny receipt of the package,

• within twenty-four (24) hours, the customer must informe about the anomalies detected to Wagenparts.com.

After the period of twenty-four (24) hours, delivery will be taken as complete and delivered products will be free from any apparent reputed vice. Consequently, ater this period, Wagenparts.com will not accept any claims because of damage, missing product, damaged package or broken pice.

Obviously the customer retains the guarantee of conformity and hidden defects for anomalies that the cusomer could not discover at the moment of the delivery.

X. RIGHT OF WITHDRAWAL

The customer has twenty-four (24) hours from the reception of the package to inform Wagenparts.com of its decision to withdraw by sending a message, with the specific web form or by e-mail, or by any other effective and unambiguous means. 

Customer must forward the pieces within a maximum period of five (5) days from the communication of its decision to withdraw.

Thus, the returned products must reach compulsorily Wagenparts.com:

• before the expiration of the above-mentioned period,

• complete and in its original packaging,

• in commercialization status (ie particularly in perfect working order, clean, unworn, undamaged).

Articles forwarded to Wagenparts.com degraded / broken / worn-out / marked by improper handling or assembly not in accordance with the manufacturer's specifications or with an insufficiently protective packaging during transport will be rejected. These returned and rejected items will not generate a refund. Customer will be informed by e-mail of the rejection and the reasons for this rejection. Within three (3) days after receipt of that e-mail, the customer has the opportunity to make known to Wagenparts.com, by e-mail or by phone, if he wants to recover the rejected article. 

All expedition and shipping costs, will be charged to the customer. 

Specific restrictions to the right of withdrawal:

In the case of Automobile articles these should be sent to Wagenparts.com under unopened package.

Oils and cleaning products can not be returned once opened.

REFUND CONDITIONS

The exercise of the right of withdrawal under appropriate conditions (see above), gives places to refund once the order has come back to Wagenparts.com. 

If the returned items are accepted by Wagenparts.com, we will proceed to refund the invoiced prices of the returned parts. In no circumstances we shall reimburse the delivery costs.

Repayment period:

The refund will be made within a maximum period of thirty (30) days from receipt of the product at Wagenparts.com, subject to acceptance of the product (see above). 

XI. RETURN OF MERCHANDISE A WAGENPARTS.COM 

Wagenparts.com offers its customers the opportunity to return the purchased items fifteen (15) working days, under the conditions described below. This period runs from the date of delivery of the order.

HOW TO PROCEED TO RETURN NEW PARTS

Returned products must come obligatorily to Wagenparts.com:

• before the expiration of the above-mentioned period,

• new,

• complete,

• and in its original and undamaged packaging.

All expedition and shipping costs, will be charged to the customer. 

Specific restrictions to the right of return:

In the case of Automobile articles these should be sent to Wagenparts.com under unopened package.

Oils and cleaning products can not be returned once opened.

Products returned to Wagenparts.com that are not new and are not in their original and undamaged packaging will be rejected. These returned and rejected items will not generate a refund. Customer will be informed by email of the rejection and the reasons for this rejection. Within three (3) days after receipt of that e-mail, the customer has the opportunity to make known to Wagenparts.com, by e-mail or by phone, if he wants to recover the rejected article.

REFUND CONDITIONS

The exercise of the right of return under appropriate conditions (see above), gives places to refund once the order has come back to Wagenparts.com. 

If the returned items are accepted by Wagenparts.com, we will proceed to refund the invoiced prices of the returned parts. In no circumstances shall we reimburse the delivery costs.

The refund will be made within a maximum period of thirty (30) days from receipt of the product at Wagenparts.com, subject to acceptance of the product (see above). 

XII. GUARANTEE

If the customer's vehicle is still under the manufacturer's guarantee, the customer can keep his vehicle with purchased parts in Wagenparts.com without losing his guarantee.

All products sold by Wagenparts.com are covered by legal guarantees of conformity and hidden defects.

The customer has a guarantee against defects in conformity of the purchased parts in Wagenparts.com.

The client, when acting in accordance with the legal guarantee:

• benefits from a period of 2 years from the expedition of the article to act;

• he can choose between the repair or the replacement of the article under certain conditions;

• is excused of demonstrating the existence of the defect of conformity of the article during twenty-four (24) months from the expedition. 

This legal guarantee of conformity applies regardless of possibly spoiled commercial guarantee.

To claim guarantee on a piece, it is essential that the customer keep the purchase invoice of the product and respects the procedures indicated by Wagenparts.com.

Attention warranties do not cover:

• the normal wear of a product (variable according to the nature of the piece),

• the defects and its consequences linked to an error of the customer who results from an employment or from an installation not in accordance with the specifications of the manufacturer or of a harmful storage to the good conservation of the piece,

• the defects and its consequences linked to the abnormal use of the vehicle on which the piece has been mounted or not in accordance with the use for which is destined (ex. use of the vehicle in competition...),

• the damages resultant from an external cause (accident, beam, current fluctuation ...).

In all these scenarios, Wagenparts.com would not be obliged to take responsibility for the defect of the part and any damage caused. 

The assumption of guarantee is subordinated to the expertise of the cause of nonconformity or vice invoked. Under the circumstances, this analysis will be performed by the manufacturer (back piece) or accepted by an expert recognized and authorized by Wagenparts.com who will move to practice the examination of the vehicle.

If all the conditions of assumption of guarantee are assembled, Wagenparts.com will refund, replace or repair the part without charge within a period of one (1) month.

XIII. LITIGATION AND RESPONSIBILITIES

This contract is subject to Spanish law.

Wagenparts.com will not be bound to the execution of this contract in the following cases:

• in cases of force majeure, as defined by the courts remain,

• if the fault lies with the customer,

• or if it is hampered by unpredictable and insurmountable circumstances of a third one.

Wagenparts.com assumes no responsibility for any consequence resulting from the misuse of products sold in Wagenparts.com.

Wagenparts.com adheres to the mediation system of e-commerce and distance selling (alternative to judicial appeal).

In case of dispute, the courts of Barcelona (Spain) will be competent.

XIV. PERSONAL DATA PROTECTION

Wagenparts.com is firmly resolved to respect individual freedoms. Wagenparts.com promises not to yield in any case (sell, exchange, lease, give, give) to third parties the data concerning a customer, except express agreement of his part.
